One application will be valid Zandler Materials (known as the Seller here on out). The signing of this credit application does not guarantee extension of credit. It is acknowledged and understood that the applicant has read, understands and agrees to both sides of this entire application and that all the information contained in this application is true and correct to the best of the application’s knowledge. The applicant authorizes the Seller to obtain credit reports or credit and funding information from other persons or entities and the applicant authorizes the release of said information to the Seller. If credit is extended, invoices are due and payable in full no later than thirty (30) days via company check from the date on which the purchase is invoiced, with no additional processing fee. The Seller will a collect 3% processing fee on payments made by credit card. Seller may collect finance charges of 1.5% per month (annual rate of 18%) which will be calculated until payment in full is made on any invoices past due. If the account balance is past due or the credit limit is exceeded the Seller reserve the right to place the account on credit hold until the balance is paid in full. The buyer agrees to pay all expenses and costs of collection incurred by Seller, including attorney’s fees of 33-1/3% of the delinquent balance owed if customer's account is placed in the hands of an attorney for collection. This agreement shall remain in effect as long as the undersigned shall remain indebted to the Seller or updated as deemed necessary by the Seller. It is agreed that the venue in any legal action shall be in Gloucester, Virginia. In witness where, the parties have caused this agreement to be executed by their duly authorized representative(s). (NOTE: If there is a partnership, all partners must sign. If an LLC or corporation, an authorized corporate officer must sign.)

All credit information listed above will be used to establish your net 30-day account, to include contacting bank references. I authorize Zandler Materials to contact my references as listed above for the sole purpose of establishing an open net 30-day account within the terms as outlined above in the "Terms & Conditions", section of this document.

GENERAL: Zandler Materials is not responsible for damages incurred to driveways, property, etc., once delivery driver leaves the state-maintained road. The customer hereby agrees to pay for all wrecker fees and to accept responsibility for damages to property and or vehicle.

MULCH CUSTOMERS / DYED MULCH CUSTOMERS: Designer color mulch must be given adequate time to dry after product has been spread. 24-48 hours without rain, moisture, or irrigation is required to ensure the highest quality of our designer products. If this is not taken into consideration the color could bleed out.

GRAVEL CUSTOMERS: Zandler Materials’ obligation is to only dump the materials in a singular location. Drivers may offer to spread gravel as a courtesy to the customer. We do not guarantee drivers will be willing to spread gravel. If a driver spreads gravel for a customer, Zandler Materials will not be held responsible for any damage, poor spreading, or gravel piles.
